BY COMMISSIONING ME YOU ACCEPT MY TERMS OF SERVICE
GENERAL TERMS♥ There are no refunds.
♥ Prices are subject to change based on demand.
♥ The artist retains all copyrights over the commissioned artwork.
♥ The artist will NOT profit further from the commissioned artwork unless the client breaks any of the terms.
♥ The artist reserves the right to post the commissioned artwork for how they see fit.
♥ Emote commissions are created solely for the client and may be used on their own platforms (Twitch, Youtube, Discord,
Twitter, etc). Gifts are allowed but the Artist only works with the Client.
♥ The artist is not responsible for the commission being stolen by a third party.
♥ Commissions may be used for profit in the form of subscriptions.
♥ Commissions may NOT be resold to a third party.
♥ Commissions may be printed or sold as merchandise.
♥ The order must be placed on ko-fi.com/briggyea and full payment must be paid and cleared before the commission is started. Payment will be in Euros.
♥ A description of the commission must be filled out with the order or the order will be considered a donation.
♥ The Artist is not responsible for any changes after the work has been approved. If additional changes are requested post
approval, there may be an additional charge.
♥ The client may commission a third party to animate the emotes as long as credit for the original artwork is given.
♥ If the client requests characters of IPs not belonging to them (e.g. fanart of existing characters), they are solely responsible
for the use of commissioned work. The artist holds no responsibility for DMCA claims due to the use of copyrighted characters.
♥ A commission is not exclusive. The client is given the commissioned artwork, not given exclusive rights to a commission or idea.
♥The artist has the right to reject any order for any reason.
♥ If the artist is unable to contact the client within 14 days of the order, it's considered a donation.
♥ If the client suddenly stops contact at any time of the commission process for a period longer than 14 days without notice the artist will consider the order a donation.
♥ The client understands that there is no physical item associated with this transaction.
PROCESS♥ Order or purchase the amount of emotes you would like to receive. If you purchase the order you agreed to the amount.
♥ Private messaging the Artist does NOT count as an order. The order must be made on Kofi.
♥ Provide a detailed description of what you expect of the commission. Preferably with references.
♥ I’ll work with sketches only if requested.
♥ I'll make the commission and present it to you. After this you get 3 revisions and we'll make sure it's perfect for you.
♥ You'll be able to follow the order through my trello.
♥ If more information is needed the commission may be delayed.
♥ Make sure I'm able to contact you, preferably through discord.
♥ The delivery estimate is not a deadline. Delays may occur. In case of a big delay you’ll be informed through the Discord server.
USES♥ Use the commissioned piece for personal use unless agreed otherwise.
♥ You have the right to use all commissions as merchandise.
♥ You can upload commissioned emotes to your BetterTTV channel or other extensions, but ONLY in private.
♥ You have the right to animate them or add something to them.
♥ You do NOT own the right to change, redraw or resell the item.
PAYMENT/REFUNDS♥ Payments must be made when requested.
♥ Currency accepted is Euro through Paypal.
♥ Full amount must be paid with placement of the order.
♥ Cancellation is not possible after payment.
♥ Refunds will only be issued if I am unable to fulfill the order.
♥ If the client requests a Paypal chargeback at any point when they were not allowed to ask for a refund they will lose all before mentioned rights to the commissioned piece and the artist will have the full right to profit further from it in any way.
The artist will decline the chargeback and supply Paypal with conversations and order placement as evidence that the artist has completed work for the client. Furthermore, the client will be blacklisted for commissioning the artist again.
DELIVERY♥ You will receive the Item(s) you commissioned.
♥ Delivery will be in the form of a google drive map unless requested otherwise.
♥ Multiple files optimized for the platforms you can use them for. Specified at order placement.
MEMBERSHIP♥ The membership gives automatic perks through kofi. If the account of the member is set up incorrectly perks can not be given.
♥ Membership perks can change at any time.
♥ If membership prices change the membership will be cancelled. The option will be given if you’d like to rejoin for the changed price.
♥ The Monthly member emotes are exclusive for members of the month. No exclusive rights can be given.
♥ Monthly member emotes will be removed once the new month’s emotes are ready. Exceptions may apply.
♥ The Perks end when the month ends and can not be taken to the next month.For the perk of a custom emote each month:
♥ You can commission a custom emote each month.
♥ Every first week of the month I’ll contact you.
♥ You have 7 days to respond and tell me your idea.
♥ Commission TOS applies.
